lown of Mashpee <br /> 16 Grew.-V k load eV)i-th <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> Re: Peter and Patricia Briggs 35 James Circle <br /> Map 71 Parcel 46 <br /> SP-05-84 <br /> A Petition was filed on June 17, 2005 for a Special Permit under Section 174-45.4 <br /> of the Zoning By-laws to legalize an existing accessory apartment on property located in <br /> an R-5 zoning district at 35 James Circle (Map 71 Parcel 46) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, June 24, 2005, and July 1, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 13, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Ron Janssen represents the applicant at this hearing. They are seeking a <br /> special permit in order to legalize an accessory apartment they have had in their home for <br /> over 10 years. Their daughter has lived in the apartment and at present the <br /> applicants/owners do not live there. Their daughter is very sick right now and they are <br /> planning to move into the house and when she gets out of the hospital, have their <br /> daughter live in the basement. There is adequate parking shown on the plan and the <br /> apartment contains 38% of the gross area of the main dwelling. The Board of Health <br /> states that no additional bedrooms are allowed and they have three total. Attorney <br /> Janssen reviews all of the by-laws for the accessory apartments and tells the board that <br /> they are complying with all of the requirements.
