Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on July 15, 2005 and July 22,
2005, a copy of which is attached hereto and made a part hereof.
Mashpee Town Hall on
A Public Hearing was held on the Petition at the Masl
Wednesday, July 13, 2005 and continued until July 27, 2005, at which time the following
members of the Zoning Board of Appeals were present and acting throughout: Zella
Elizenberry, Marshall Brent, Jonathan Furbush, Eric Dublirer and James Reiffarth..
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Donna Reed represents herself at this hearing. She is seeking a variance in order
to install a built in swimming pool on her lot. She is burdened with maintaining two
frontages as her lot sits on the corner of Devonshire Drive and Cambridge Drive. There
are no abutters with any concerns on this application. This matter was continued from
July 13, 2005 as the Board required a total lot coverage figure on the set of plans from the
engineer. The structures on the property both existing and proposed will be 12.4% which
is well under the 20% maximum allowable lot coverage. The Board moves to grant a 9.2
foot variance on the Devonshire Drive side.
