• <br />0 <br />:i <br />Mashpee Zoning <br />Board of Appeals Minutes <br />1 July 13, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, July 13, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, July 13, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Evano Cunha and Marshall Brem were present along with alternate members <br />Jonathan Furbush., James Reiffarth and Eric Dublirer. Board member Frederick <br />Borgeson was absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Mr. Nelson informed the Board that the first order of business is to re -organize the Board. <br />He told them that in speaking with Town Clerk Debra Dami, only the full time members <br />may nominate and vote on this matter. However, Mr. Nelson will appoint Jonathan <br />Furbush to replace Frederick Bergeson in the voting process. Zella Elizenberry opened <br />the nomination of Robert Nelson for Chairman. Johnathan Furbush seconded the <br />nomination. So moved. Robert Nelson nominated Zella Elizenberry for Vice Chairman. <br />Jonathan Furbush seconded the nomination. So moved. Robert Nelson nominated <br />Marshall Brem for Clerk. Zella Elizenberry seconded the nomination. So moved. <br />The Chairman will continue to be Robert Nelson, the Vice- Chair will now be Zella <br />Eliznebeny and the Clerk will be Marshall Brem. <br />Zella Elizenberry reads the continuances/withdrawals for this evening. <br />Christian Valle regarding River Hill: Mr. Valle was called to discuss the partial release <br />of his bond. He was not present at this hearing and the Board will hear from him when <br />the fence is complete, possibly on July 27, 2005. <br />Brenda Richerson: Ms. Richerson is representing her aunt who owns 4 lots on Hicks <br />Road and wants to deed them out to her nieces and nephews to build on. She has been <br />paying taxes on them for over 25 years and has now been told that they are not buildable <br />lots. Mr. Nelson has spoken with the Town Planner who has suggested that they create a <br />limited dividend corporation and donate one of the lots to habitate for humanity thereby <br />circumventing the need to adhere to the lot size requirements and other zoning issues that <br />are preventing these lots from being buildable. Mr. Nelson further informs her that since <br />a decision just came down from the Land Court against the ZBA since 2000, the <br />variances they have been giving out to make lots buildable are not legal. <br />
