Mashpee Zoning <br />Board of Appeals Minutes <br />. 3 July 13,2005 <br />Islands Engineering, dated July 21, 1995, revised May 26, 2005 and revised June 30, <br />2005. <br />Scott Wurster: Requests a Special Permit from Section 174-20 of the Zoning By-laws <br />in order to demolish a pre-existing non -conforming dwelling and rebuild a new dwelling <br />on property located in an R-3 zoning district at 4 Bayview Road (Map 119 Parcel 32) <br />Mashpee, MA. <br />Scott Wurster: Requests a Variance from Section 174-31 of the Zoning By-laws to seek <br />relief from the setback requirements, frontage requirements, frontyard setback <br />requirements and landspace requirements in order to build a new dwelling on property <br />located in an R-3 zoning district at 4 Bayview Road (Map 119 Parcel 32) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Evano Cunha and Jonathan <br />Furbush. <br />Scott Wurster represents himself at this hearing. He is seeking a special permit in order <br />to demolish the existing cottage and rebuild a new three bedroom dwelling. The <br />proposed plans change the footprint of the existing house with currently exists as a non- <br />conforming structure on a 4,293 square foot lot. Mr. Wurster has not calculated the lot <br />coverage which appears to be well over the maximum allowable 20%. The Board agrees <br />• that the existing dwelling needs to be torn down but Mr. Wurster has not filed for lot <br />coverage relief and the Board informs him that they will not allow more than 20%. Mr. <br />Wurster withdraws the current variance and will re -file for a lot coverage variance. The <br />Board informs him that they do n6t allow this unless there are extreme medical <br />conditions that would require such a variance. Mr. Wurster still plans to pursue this <br />matter at the next available hearing. The Board moves to grant the special permit. <br />Howard Finkel: Requests a Special Permit from Section 174-45.4 of the Zoning By- <br />laws in order to build an accessory apartment on property located in an R-5 zoning <br />district at 248 Falmouth Road (Map 62 Parcel 6) Mashpee, MA. <br />Howard Finkel: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements in order to build a 24' x 30' garage with an <br />accessory apartment above on property located in an R-5 zoning district at 248 Falmouth <br />Road (Map 62 Parcel 6) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and Evano <br />Cunha. <br />Howard Finkel represents himself at this hearing. He is seeking a variance to build a <br />garage with an accessory apartment above it for his parents that will summer here. He <br />resides in the property which is one of the requirements for an accessory apartment <br />• permit. He is unable to meet the setbacks in order to have the garage which is why he <br />needs the variance. The Board of Health has issued the comment that he must hook up to <br />
