`�1U\6'N rye. lown of ce <br /> ws+aueFi ^� Washpec, Allossachusetts 0"21649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Stephen and Karen Petrucci 8 Wilsons Grove <br /> Map 118 Block 67 <br /> SP-05-90 <br /> A Petition was filed on June 29, 2005 by Karen Petrucci for a Special Permit <br /> under Section 174-17 of the Zoning By-laws for permission to construct an addition to a <br /> non-conforming dwelling on property located in an R-3 zoning district at 8 Wilsons Gove <br /> (Map 118 Block 67) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 15, 2005 and July <br /> 29, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 27, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G. Nelson, Zella Elizenberry, <br /> Marshall Brem, Eric Dublirer and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Karen and Stephen Petrucci represent themselves at this hearing. They have made <br /> some added a second floor to the existing cottage but have been informed that since the <br /> balcony cantilevers on the side they must get a special permit to alter a pre-existing non- <br /> conforming structure since the area cantilevered over would not meet the current setback <br /> requirements. There are several houses in this area that are very tightly built onto small <br /> pieces of land. The footprint has not changed but the building department felt this permit <br /> was necessary. The Board feels the special permit request is reasonable and moves to <br /> grant the special permit. <br />
