Mashpee Zoning Syrul Lurie 2 <br /> Board of Appeals V-05-93 <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the Petitioner met the criteria for grant of a Special Permit under Section <br /> 174-25.I.9. <br /> 2. the proposed construction will be an accessory to an existing dwelling. <br /> 3. the proposal has been approved by the Shellfish Constable whose <br /> responsibilities include protection of the marine environment. <br /> 4. the proposal has been reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> 5. the use is in harmony with the general purpose and intent of the By-laws. <br /> 6. the owner has rights to maintenance in perpetuity. <br /> 7. filing with the State DEP Wetlands Program shall be considered execution of <br /> the Special Permit. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on July 27, 2005 to <br /> grant a Variance of 91 feet to allow for the proposal on the subject property. The <br /> Variance is conditioned upon compliance with plans from CME Associates, Inc. of <br /> Southbridge MA, dated March 1, 2005, Project 2005049, and Plans from Horsley Witten <br /> Groupof Sandwich, MA, dated February 15, 2005,project 4065. <br />
