Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on July 15, 2005 and July 22,
2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, July 27, 2005, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenber7y,
Jonathan Furbush, Eric Dublirer and Marshall Brem.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Attorney Kevin Kirrane represents the applicant at this hearing. He is seeking a
variance in order to build a one car shed style detached garage and cannot maintain his 25
foot setback requirements or his 40 foot front yard setback requirement. Applicant is an
elderly man who needs a garage to maintain his vehicle and other storage items. The lot
has specific topographical problems which prevents him from moving it any further back.
Mr. Brem states that he visited the area and feels this will enhance the neighborhood.
Abutters Henry and Rachel Catsoulis support the project as they are direct abutters. The
Board moves to grant the requested variances.
