Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on July 15, 2005 and July 22, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 27, 2005, at which time the following members of the Zonning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Nancy Mihos represents herself at this hearing. She is seeking a variance in order to <br /> put an 8' x 12' shed three off of her property line. The R-5 zoning district requires that a <br /> structure be 25 feet off the lot line. However, having a shed sitting in the middle of your <br /> yard is not the point of a shed and is not appealing. The Building Department feels that <br /> this by-law, which was defeated at the last town meeting, is excessive. They feel five <br /> feet off the lot line is acceptable. Mr. Nelson asks if the shed is on blocks which would <br /> make it portable. The applicant says that it is and the board feels as long as it is on <br /> blocks it would not be considered a permanent structure. Ms. Mihos would accept five <br /> feet from lot line as opposed to the three feet that was originally requested. The board <br /> moves to grant a variance that would allow the shed to be five feet off the lot line. <br />
