Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on July 15, 2005 and July 22,
2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, July 27, 2005, at which time the following members of the Zonning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Marshall Brem, Jonathan Furbush and James Reiffarth.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Nancy Mihos represents herself at this hearing. She is seeking a variance in order to
put an 8' x 12' shed three off of her property line. The R-5 zoning district requires that a
structure be 25 feet off the lot line. However, having a shed sitting in the middle of your
yard is not the point of a shed and is not appealing. The Building Department feels that
this by-law, which was defeated at the last town meeting, is excessive. They feel five
feet off the lot line is acceptable. Mr. Nelson asks if the shed is on blocks which would
make it portable. The applicant says that it is and the board feels as long as it is on
blocks it would not be considered a permanent structure. Ms. Mihos would accept five
feet from lot line as opposed to the three feet that was originally requested. The board
moves to grant a variance that would allow the shed to be five feet off the lot line.
