Mashpee Zoning <br />Board of Appeals Minutes <br />1 July 27, 2005 <br />• <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, July 27, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, July 27, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, and Marshall Brem were present along with alternate members Jonathan <br />Furbush., James Reiffarth and Eric Dublirer. Board members Frederick Borgeson and <br />Evano Cunha were absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Zella Elizenberry reads the continuances. <br />Continued Matters <br />Margaret Lawton: Request for release of $5,000 bond for 89 Industrial Drive. <br />• Applicant has met his obligations. <br />Robert Nelson reads the letter from Mary LeBlanc of the Design Review Committee. It <br />states that the obligations have been met by the tenant/owner Robert Lawton of 89 <br />Industrial Drive. That being said, Marshall Brem makes a motion to release the $5,000 <br />bond. Zella Elizenberry seconds the motion. All agree. So moved. <br />Christian Valle: Discussion of the Bond regarding River Hill <br />It is discussed whether or not Mr. Valle is here to ask for his bond release. It appears he <br />is not present. <br />Christopher and Donna Reed: Requests a Variance from Section 174-31 of the Zoning <br />By-laws to seek relief from the setback requirements in order to install a 16' x 34' in - <br />ground pool on property located in an R-5 zoning district at 36 Cambridge Drive (Map 16 <br />Parcel 71) Mashpee, MA. <br />Sitting: Robert Nelson steps down from this matter. Zella Elizenberry, Marshall Brem, <br />Eric Dublirer, Jonathan Furbush and James Reiffarth. <br />This matter was continued from July 13°i in order to have the lot coverage depicted on <br />the plot plan that includes the pool and other structures on the lot. The coverage is 13% <br />and is below the 20% allowable maximum. The applicant is burdened with maintaining <br />• two street frontages which is why she needs relief in order to install a swimming pool. <br />Marshall Brem moves to grant a 9.2 foot variance to Devonshire Drive.
