q a <br /> h. lown of Mashpec <br /> 16 Great Aerc (kaa(1,Ni)i-th, <br /> Mashpee, (Ylassach,usetts O�2649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Scott Wurster 4 Bayview Road <br /> Map 119 Parcel 32 <br /> V-05-99 <br /> A Petition was filed on July 14, 2005 by Scott Wurster for a Variance from <br /> Section 174-31 of the Zoning By-laws to seek relief from the setback requirements in <br /> order to build a new dwelling on property located in an R-3 zoning district at 4 Bayview <br /> Road (Map 119 Block 32) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on July 22, 2005 and July 29, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> f <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 27, 2005 and Wednesday, August 24, 2005 at which time the following <br /> members of the Zoning Board of Appeals were present and acting throughout: Robert <br /> Nelson, Zella Elizenberry, Marshall Brem, Evano Cunha and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to,the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Scott Wurster represents himself at this continued hearing from July 27, 2005. He <br /> was before the board to request a variance to the lot coverage because the new dwelling <br /> that he wanted to build was more than the 20% maximum allowable coverage. Although <br /> the lot is only 4,300 square feet, he still must not exceed the 20% lot coverage that the <br /> board requires. The Board asked him to come back with plans that will accommodate <br /> this requirement. Mr. Wurster presented a new plan that put his dwelling at 19.3% lot <br /> coverage. The Board reviewed the plans and discussed the sideyard variance with the <br /> Assistant Building Inspector regarding the stairs. It has been determined that Mr. <br /> Wurster needs sideyard relief on both sides and frontyard relief. The Board also asks him <br />
