Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on August 5, 2005 and August
12, 2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, September 14, 2005, at which time the following members of the Zoning
Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Marshall Brem, Frederick Borgeson and Evano Cunha.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
David Sanicki of Cape & Islands Engineering, represents the petitioner at this
hearing. They are seeking a variance to the wetlands by 6 feet in order to build a new
house with a garage, patio and porch. Conservation has approved the plans and they
meet all of the other setback requirements. The lot coverage is 20%. The Board feels this
will be an improvement to the area however Evano Cunha is not in favor of granting
variances to the wetlands and feels the land should be preserved at all costs, especially
considering what just happened down south. The Board reviews the plans and Marshall
Brem makes a motion to grant a 6- foot variance to the wetlands. Frederick Borgeson
