t(D1V yop <br /> lown of Mashpee <br /> ' 16 �r ea,t deck cl Vc oa )r-th <br /> MASHPEE ZONING BOARD OF APPEA <. <br /> ' (I hpcc, Nla.ssa,ch,USC' is 0264J <br /> DECISION FOR A VARIANCE <br /> Re: Thomas P. and Patricia Dargan 5 Uncatena Road <br /> Map 123 Parcel 71 <br /> V- 05-101 <br /> A Petition was filed on August 2, 2005 for a Variance under Section 174-33 of the <br /> Zoning By-laws for permission to vary the required distance to the wetlands in order to <br /> construct a new home on property located in an R-3 zoning district at 5 Uncatena Road <br /> (Map 123 Parcel 71) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 5, 2005 and August <br /> 12, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Frederick Borgeson and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Islands Engineering, represents the petitioner at this <br /> hearing. They are seeking a variance to the wetlands by 6 feet in order to build a new <br /> house with a garage, patio and porch. Conservation has approved the plans and they <br /> meet all of the other setback requirements. The lot coverage is 20%. The Board feels this <br /> will be an improvement to the area however Evano Cunha is not in favor of granting <br /> variances to the wetlands and feels the land should be preserved at all costs, especially <br /> considering what just happened down south. The Board reviews the plans and Marshall <br /> Brem makes a motion to grant a 6- foot variance to the wetlands. Frederick Borgeson <br />
