Conway 8 Alma Road <br /> Map I I I Block 198 <br /> V-05-100 <br /> A Petition was filed on July 29, 2005 for a Variance from Section 174-31 of the <br /> Zoning By-laws for permissioal to vary the sideyard setback requirements to build a <br /> garage on property located in an R-3 zoning district at 8 Alma Road (Map I I I Block <br /> 198) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 12, 2005 and <br /> August 19, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 24, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Eric Dublirer and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Conway represents himself at this hearing. He is seeking a sideyard variance <br /> in order to build a garage. They spend about 6 months of the year in Florida and would <br /> like to leave one car here and need a garage to do so. Mr. Nelson reads a letter of <br /> opposition from James Corbett, a direct abutter. He does not want this variance to be <br /> granted but does not explain why. Mr. Breen mentions that he met Mr. Corbett upon his <br /> site inspection at Mr. Conway's property. He informs the board that although Mr. <br /> Corbett doesn't want any hard feelings between neighbors, he does not want the garage <br /> so close to his property. Mr. Brem asks the applicant what his hardship is? Mr. Conway <br /> says that if he built the garage anywhere else, a couple of beautiful trees would have to be <br />
