Mashpee Zoning <br />Board of Appeals Minutes <br />1 August 24, 2005 <br />• TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, August 24, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, August 24, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Marshall Brem, Evano Cunha along with alternate board members Jonathan <br />Furbush, James Reiffarth and Eric Dublirer. Board member Frederick Borgeson was <br />absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Zella Elizenberry read the continuances. Mr. Brem mentions that he is not in favor of <br />allowing all of these applicants so many continuances. Mr. Nelson says they will address <br />this later in the hearing. <br />Informal: Request from realtor from Jack Conway's office about questions on <br />accessory apartment and being owner occupied. <br />• Lori Corsi tells the Board that a realtor from Jack Conway's office, Rick Lesniewicz, <br />asked about the accessory apartment by-law. He wanted to know if the owner of the <br />house could rent out the larger part of the home and use the apartment for himself He <br />also asked if he could rent the house with the accessory apartment blocked off or with it. <br />open. Zella Elizenberry states that the intention of the bylaw is such that the owner must <br />reside in the main part of the dwelling and that the only part that can be rented out or <br />used by family is the accessory apartment. They will not allow any deviation from the <br />intent of that portion of the by-law. <br />Continued Matters <br />Scott Wurster: Requests a Variance from Section 174-31 of the Zoning By- <br />laws to exceed the maximum allowable 20% lot coverage to build an <br />addition on property located in an R-3.zoning district at 4 Bayview Road <br />(Map 119 Parcel 32) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Evano Cunha and James <br />Reiffarth. <br />Scott Wurster represents himself at this continued hearing from July 27, 2005.
