Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on August 26, 2005 and
September 2, 2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, September 14, 2005 at which time the following members of the Zoning
Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Marshall Brem, Evano Cunha and Frederick Borgeson.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Robert Bergeron represents himself at this hearing. He is seeking variances on his
property for setback relief in several areas in order to build a garage with a breezeway
and porch. Mr. Bergeron is burdened with maintaining three frontages and the lot has
problematic topography. The Board reviews the plans and mentions that the Board of
Health has requested the septic system to be re-inspected. After some discussion on the
lot shape, the Board moves to grant the following:
✓ 3.9 foot variance on the sideyard
✓ 9.2 foot variance on the sideyard
✓ 21.6 foot variance on the front yard
✓ 24.3 foot variance on the front yard
✓ 12.6 foot variance on the front yard
