TvTy 6 <br /> Town of Mashpee <br /> ��. 16 Great .Neck load J%rth <br /> LE Nlcishpee, Massachuscas O2649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: George Adams 47 Cove Road <br /> Map 5 Parcel 1 <br /> V-05-103 <br /> A Petition was filed on August 10, 2005 by George Adams for a Variance from <br /> Section 174-32of the Zoning By-laws seeking relief from the fire protection code to <br /> exceed the 150 foot access requirement in order to build a single family dwelling on <br /> property located in an R-3 zoning district at 47 Cove Road (Map 5 Parcel 1) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 26, 2005 and <br /> September 2, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Frederick Borgeson and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Islands Engineering represents Mr. Adams in this <br /> matter. They are seeking relief from the fire protection law due to the fact that the <br /> farthest point is from the dwelling is 150 feet from pavement for the fire trucks. <br /> Conservation has approved this project. Petitioner is seeking an 5-foot variance. The <br /> Board moves to grant the requested variance. <br />
