6 <br /> Board's engineer has forwarded written approval of the final system design to the <br /> Board of Appeals. The Board's engineer shall approve the maintenance schedule for <br /> the storm water system and the final design thereof. <br /> 16. As security for completion of the infrastructure shown on the Plans, as conditioned <br /> hereby, including but not limited to the roadway/driveway, and drainage facilities, <br /> and utilities (collectively the "Infrastructure"), the release of occupancy permits for <br /> the housing shall be subject to the following restrictions: <br /> a. No occupancy permit for a unit in any building shall be issued until: (1) <br /> the base and binder course for the entire roadway shown on the Plans has <br /> been installed, except that the final four occupancy permits shall not be <br /> issued unless and until the final topcoat of paving has been completed; and <br /> (2) all other Infrastructure as shown on the final Plans, as approved by the <br /> --- T�oard nes ginee—r-has been=e6!r-1smtcied or installed so-ag-tu-aci te�l - <br /> serve said building.. <br /> b. No occupancy permits shall be issued until the Petitioner complies with <br /> any other requirements or specifications that are reasonably required by <br /> the Board's engineer after review of the final construction plans. <br /> C. Upon completion of all such Infrastructure,the Board's engineer shall <br /> inform the Board accordingly who may authorize the release of occupancy <br /> permits. No occupancy permit shall be issued without such authorization <br /> and such authorization shall be ineffective unless it is in writing. <br /> 17. During construction,the Applicant shall maintain all feasible and reasonable means <br /> of dust control and shall collect all debris on a daily basis. No construction may <br /> occur on Sundays or on New Year's Day, Memorial Day, July 4th, Labor Day, <br /> Thanksgiving, or Christmas. No construction may begin before 7:00 a.m. nor <br /> continue past 6:00 p.m. <br /> 18. Unless and until the roads are accepted as public ways, snow and ice removal shall be <br /> the responsibility of the owners of the development. Snow and ice removal shall be <br /> undertaken as soon as is practicable after snowfall and shall not impede or obstruct <br /> the roadway and driveways or the sight lines thereon. Accumulated ice on the <br /> roadway, driveways and parking lots shall be promptly removed or sanded such that <br /> vehicles may pass safely. No sodium-based de-icers shall be permitted. <br /> 19. The Applicant shall, to the maximum extent feasible, maintain as many of the <br /> existing trees as possible. <br /> 20. This permit shall not be valid until recorded with the Barnstable County Registry of <br /> Deeds and evidence of such recording is provided to the Inspector of Buildings and <br /> the Board of Appeals. <br /> 21. The Applicant shall obtain a final loan commitment from Massachusetts Housing <br /> Finance Agency prior to the issuance of any building permit. Any proposed change <br /> in the subsidy source shall be deemed a substantial material change requiring a <br /> hearing and approval of the Board in addition to re-issuance of a complying eligibility <br /> letter. <br />
