HOIPry <br />lown of Mashpec <br />MASHPEE ZONING BOARD OF APPEAL <br />16 Ot"ELtt NA �&oaC( (C)i , <br />r9mY "—, eti <br />_ICtshpcP., Mctssac tUSCUS 02649 <br />RE: Brian Kantor <br />Decision for a Special Permit <br />36 & 40 Great River Road <br />Map 120 Parcels 69 and 70 <br />SP-05-120 <br />A Petition was filed on October 3, 2005 for a Special Permit tinder Section 174- <br />25.I.9 of the Zoning By-laws to build a pier, ramp and float on property located in an R-3 <br />zoning district at 36 and 40 Great River Road (Map 120 Parcels 69 and 70) Mashpee, <br />MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on October 7, 2005 and <br />October 14, 2005, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on October 26, 2005 on the Petition at the Mashpee <br />Town Hall at which time the following members of the Zoning Board of Appeals were <br />present and acting throughout: Robert Nelson, Zella Elizenberry, Marshall Brem, <br />Frederick Borgeson and Jonathan Furbush. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Christopher Costa of Christopher Costa Engineering represents the applicant at <br />this hearing. They are seeking a special permit in order to build a pier, ramp and float. <br />There is a memo from Mr. York, the shell fish officer who has asked that the float be <br />changed from 8 feet to 6 feet — the plans shown accommodate that change. The length of <br />the pier from the MHW is 70 feet. After reviewing the plans the Board moves to grant <br />the Special Permit. <br />
