VMN <br /> Town of <br /> �F�w.1;.�tr66'®may Mashpee <br /> 16 G feat,,sec k load JVorth, <br /> MASHPEE ZONING BOARD OF APPEAIa , NIassaclausetts 0269 <br /> �aii� cam^ <br /> Decision for a Special Permit <br /> RE: Richard Kearney 429 Monomoscoy Road <br /> Map 124-54 Parcel A2 <br /> SP-05-126 <br /> A Petition was filed on October 20, 2005 by Richard Kearney for a Special Permit <br /> under Section 174-25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp <br /> and float on property located in an R-3 zoning district at 429 Monomoscoy Road (Map <br /> 124-54 Parcel A2) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 25, 2005 and <br /> December 2, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Zella E. Elizenberry, Robert <br /> Nelson, Frederick Borgeson , Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Jack Landers-Cauley, Engineer is representing the applicant at this hearing. They <br /> are seeking a Special Permit for a marine recreation dock/float. The Board reviews the <br /> plans and Mr. Cauley informs them that it will be 61.9 feet from the MHW, less than the <br /> allowable 70 feet. Mr. Nelson informs the Board that a letter from an abutter, Mr. <br /> Edward Allen is read into the record. He does not want any illumination on the dock so <br /> as to preserve the beauty of the water at night. Mr. Cauley says that his client will adhere <br /> to that and there will be no illumination. Mr. Borgeson asks what "Marine Recreation" <br /> means as opposed to just a regular pier, ramp and float that they usually get asked to <br /> approve.
