Town of Mashpee <br /> 16 Gweot,jVeck &od,M)aJi, <br /> -Washpec, 1YI(issachtisetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: George and Nancy Dubin 31 Fiddler Crab Lane <br /> Map 105 Parcel 107 <br /> V-04-10 <br /> A Petition was filed on November 25, 2003 for a Variance from Section 174-31 <br /> of the Zoning By-laws for permission to vary the distance of the pier, ramp and float's <br /> requirements off the property line to allow for construction of a pier, ramp and float on <br /> Ockway Bay property located in an R-3 zoning district at 31 Fiddler Crab Lane (Map 105 <br /> Parcel 107) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 23, 2004 and <br /> January 30, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 11, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Zella Elizenberry, Robert Nelson <br /> and James Regan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Island Engineering represented the petitioners. <br /> They are seeking a 5- foot variance due to the fact that the proposed pier, ramp and float <br /> will only be 10-feet off of the property line and 15-feet is required. <br /> No other comments were received from abutters <br />
