lown of Mashpee <br /> 16 GreatNeck 1�oacl,Xh <br /> V�nineco eh Al(ishpee, -Mass(tchusetis 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: John and Lena Malone 52 Hemlock Drive <br /> Map 29 Parcel 34 <br /> SP-04-16 <br /> A Petition was filed on January 20, 2004 for a Special Permit under Section 174- <br /> 25.A.8 of the Zoning By-laws to legalize an existing accessory structure on property <br /> located in an R-3 zoning district at 52 Hemlock Drive (Map 29 Parcel 34) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, January 23, 2004, and <br /> January 30, 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 11, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws, <br /> John Malone represented himself at this hearing. He is seeking to legalize an <br /> existing in-law apartment that he has had since 1987 when he applied to this Board for <br /> relief. At that time he was told to go ahead and use it since there was no such use in the <br /> by-laws at that time. He was issued an occupancy permit and has been using it since <br /> then. He would now like to legalize it according to the new by-laws. <br /> No comments from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 52 Hemlock Drive and contains 93,796 square <br /> feet. <br />
