lown of Mashpee <br /> 16 Grcw N(,(.k &ad,j'W)ah, <br /> ii[E Nlctshl)cc, Nlassachusetts 0P2649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Elizabeth Johnson 14 High Sachem Road <br /> Map 61 Block 39 <br /> A Petition was filed on January 16, 2004 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the front and side yard setback requirements in order to construct <br /> a 24' x 26' garage and mudroom area to the existing dwelling on property located in an <br /> R-3 zoning district at 14 High Sachem Road (Map 61 Block 39) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 23, 2004 and <br /> January 30, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> February 11, 2004, at which time the following members of the Zoning Board of Appeals <br /> were present and acting thro <br /> ughout: Robert G. Nelson, James Regan and Zella E. <br /> Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Elizabeth Johnson represents herself at this hearing. She is seeking a variance in <br /> order to construct at 26' x 24' garage and mudroom area. Due to the fact that her lot is a <br /> corner lot, there is an undue burden to adhere to the current zoning on both sides of her <br /> lot. She is required to maintain 40 feet from the front although she has two fronts to <br /> maintain. Petitioner is seeking a 25-foot variance on the northerly side to accomplish this <br /> addition. The Board would like to see mixed shrubbery 4-8 feet in height along the side <br /> of her foundation and they are to be 5 feet from the building. One abutter, Clint Owen of <br /> 31 High Sachem Road inquires about where the garage is going. They review the plans <br /> and Mr. Owen has no problems with the addition. <br />
