lown of Mashpcc <br /> 16 Great, ,Aeck ltoa(l )Vorlh. <br /> Mashpee, Nlassachusetts 02649 <br /> ZU <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: George and Nancy Dubin 31 Fiddler Crab Lane <br /> Map 105 Parcel 107 <br /> SP-04-09 <br /> A Petition was filed on November 25, 2004 by George and Nancy Dubin, for a <br /> Special Permit under Section 174-25.1.9 of the Zoning By-laws to allow for construction <br /> of a pier, ramp and float on Ockway Bay on property located in an R-3 zoning district at <br /> 31 Fiddler Crab Lane (Map 105 Parcel 107) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 23, 2004 and <br /> January 30, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 11, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Zella E. Elizenberry, James Regan <br /> and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petitioners. <br /> They are seeking a special permit in order to construct a pier, ramp and float on the <br /> subject property. <br /> The Shellfish Constable and the Conservation Commission have approved the <br /> proj ect. <br /> No comments were received from abutters. <br />
