Mashpee Zoning Minutes <br /> Board of Appeals February 11, 2004 <br /> 1 <br /> TOWN OF MASHPEE <br /> • Zoning Board of Appeals <br /> Minutes - Wednesday, February 11, 2004 <br /> THE TAPE IS NOT PART OF THE HEARING: IT IS FOR THE PURPOSE OF <br /> TRANSCRIPTION ONLY <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, February <br /> 11, 2004 at 7:00 P.M. at the Mashpee Town Hall. Vice Chairman James Regan and <br /> Clerk Robert Nelson and new Board Member Zella Elizenberry were present along with <br /> Associate Members Marshall Brem and Frederick Borgeson. Richard Guerrera was <br /> absent. <br /> Mr. Regan brought the meeting to order at 7:00 p.m. <br /> First order of business was to congratulate Zella Elizenberry as the newest full time board <br /> member. Welcome Zella! <br /> NEW PUBLIC HEARINGS <br /> George and Nancy Dubin: Request a Special Permit from Section 174-25 (I)(9) of the <br /> Zoning By-laws in order to construct and maintainl a pier, ramp and float on property <br /> located in an R-3 zoning district at 31 Fiddler Crab Lane (Map 105 Parcel 107) Mashpee, <br /> MA. <br /> AND <br /> George and Nancy Dubin: Request a Variance from Section 174-31 of the Zoning By- <br /> laws in order to install a pier, ramp and float that will not meet the minimum 15-foot <br /> setback requirement on property located in an R-3 <br /> Sitting: James Regan, Robert Nelson and Zella Elizenberry. <br /> Dave Sanicki of Cape & Islands Engineering represented the petitioners. They are <br /> seeking to build a pier ramp and float and also need a variance due to the fact the dock <br /> will be more than 10 feet off the side line. They are looking for a 5 foot variance. Mr. <br /> Sanicki reviews the plans the with the Board. The Board feels this is a reasonable <br /> request. Mr. Regan reads the comments from Mr. York, Shellfish Agent and he sees no <br /> problems with this request. Ms. Elizenberry moves to grant the Special Permit and a 5- <br /> foot variance on the southerly sideline. Mr. Nelson seconds the motion. All agree. So <br /> moved. Reference plans by Cape & Islands Engineering, dated November 14, 2003, Plan <br /> No. 111403. <br />
