"lown of Nlashpee <br /> N 4 <br /> 16 Ga-cot ,Vcck load WV)rth <br /> N[ashl)ee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance—DENIED <br /> RE: Nancy Morey 10 Seneca Avenue <br /> Map 65 Parcel 119J <br /> V-04-01 <br /> A Petition was filed on December 30, 2003 by Nancy Morey for a Variance from <br /> Section 174-31 of the Zoning By-laws to legalize an existing deck not meeting current <br /> setback requirements on property located in an R-3 zoning district at 10 Seneca Avenue <br /> (Map 65 Parcel 119J) Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 2, 2004 and <br /> January 9, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 22, 2003, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James Regan, Zella Elizenberry and <br /> Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Marshall Brem feels this matter has going on far too long. He has visited the site <br /> and the deck is illegal and was never inspected. Attorney Craig Martin has represented <br /> this petitioner since December 2003 and has continued this more than 5 times due to the <br /> fact that he could not retain and engineer for a certified plot plan. The Board feels this <br /> has gone on long enough and the Attorney should have been able to get a plot plan by <br /> now. Marshall Brem makes a motion to deny with prejudice the variance request. <br /> Richard Guerrera seconds the motion. All agree. So denied. <br /> t: <br />
