Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 23, 2004 and <br /> January 30, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 18, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Marshall Brem, Robert Nelson and <br /> James Regan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane of Dunning & Kirrane represented the petitioners. After <br /> more than a year of working out a compromise between opposing abutters, petitioner has <br /> submitted a plan for a 46 foot pier, ramp and float that accommodates everyone's <br /> concerns. The dock will extend 46-feet to MHW with a 6' x 25' float and a 3' x 18' <br /> ramp. Mr. Frederick Viles continues to go on record opposing this Special Permit. All <br /> other abutters are satisfied with the current plan on file. Conservation has been satisfied <br /> as well as the Harbormaster with the current plans. The Board moves to grant the Special <br /> Permit. All agree. So moved. <br /> i <br />
