Herbert 147 Shore Drive <br /> Map 117 Parcel 68 <br /> V—04-07 <br /> A Petition was filed on November 26, 2003 for a Variance under Section 174-33 <br /> of the Zoning By-laws to seek relief from the required distance to the wetlands in order to <br /> construct a 60' x 47' house and garage with a 5'6 x 34' porch on property located in an <br /> R-3 zoning district at 147 Shore Drive (Map 117 Parcel 68) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 2, 2004 and <br /> January 9, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 18, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Marshall Brern. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents the petitioner in this <br /> matter. They are seeking a variance from the distance to the wetlands and a special permit <br /> in order to demolish the existing structure. Conservation as approved this wetlands <br /> matter. A new septic system will be installed. The Board feels this will be an <br /> improvement to the area. Mr. Nelson moves to grant the special permit and a 9-foot <br /> variance to the wetlands. Marshall Brem seconds the motion. All agree. So moved. <br />
