Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on January 9, 2004 and January 16, 2004, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, March 10, 2004, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry and Marshall Brem. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. John Slavinsky of Cape & Islands Engineering represents the petitioners at this hearing. They are seeking a special permit for a commercial building that will involve the use of metal products and architectural steel work. Metal fabricating will be sent out of the building to be completed. Design Review has approved the plans. There is some discussion regarding the distance in the back of the building due to a portion of the lot being in a residential zone. They have twisted the building therefore accommodating all concerns. No comments were received from abutters. 7
