Mashpee Zoning <br /> Board of Appeals Minutes <br /> 2 February 18, 2004 <br /> Mr. Regan would like to see a pro forma with the new updated dollar figures <br /> incorporated. The Board all agrees that these changes are minor and are fine with the <br /> above changes. So moved. <br /> Daniel Baker: Requests a Variance under Section 174-31 of the Zoning By-laws in <br /> order to vary the front yard setback requirement to complete a 10'x16' sunroom with a <br /> 14' x 24' garage and 8' x 34' farmer's porch on property located in an R-5 zoning district <br /> at 2 Sunset Circle (Map 64 Parcel 1) Mashpee, MA. <br /> Sitting: James Regan, Marshall Brem and Robert Nelson. <br /> Carl Delorme represents the petitioner at this hearing. He is seeking a variance from the <br /> front yard setback requirements in order to build a farmer's porch and garage. The Board <br /> reviews the plans and they feel this will be an improvement to the house. Robert Nelson <br /> moves to grant an 11-foot variance for the farmer's porch and a 6-foot variance for the <br /> garage on Sunset Circle. Marshall Brem seconds the motion. All agree. So moved. <br /> Reference site plans from Norman Grossman of East Falmouth, MA, Plan No. C-721-R2, <br /> dated October 1, 2003 as prepared for Mid Cape Construction. <br /> Paul Squarcia: Requests a Variance from Section 174-31 of the Zoning By-laws in <br /> order to vary the setback requirement off the property line for a pier, ramp and float on <br /> property located in an R-3 zoning district at 108 Wading Place Road (Map 111 Parcel <br /> 107) Mashpee, MA. <br /> AND <br /> Paul Squarcia: Requests a Special Permit under Section 174-25 (1)(9) of the Zoning By- <br /> laws in order to construct, maintain and license a pier, ramp and float on property located <br /> in an R-3 zoning district at 108 Wading PlaceRoad (Map 111 Parcel 107) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson and Marshall Brem. <br /> Kevin Kirrane represents petitioner on this matter that has been before the Board for over <br /> one year. This is a new filing with what petitioner believes is a compromise to <br /> accommodate all parties that were previously opposed to the length of the 87' foot dock. <br /> They have modified the dock to 46', which will accommodate for the moorings. The <br /> Board feels this is a great compromise to an ongoing situation between neighbors. <br /> Frederick Viles, of 21 Bright Coves Way across the waterway, feels this is still <br /> inappropriate. He continues to point out that it is too tall and will interfere with his view. <br /> The Board feels they have heard enough from Mr. Viles due to the fact that Mr. Viles <br /> simply does not want any dock there at all. Mr. Keats Boyd, III has two questions (1) <br /> will there be a limit of boats and (2) are they the same plans that have recently been filed? <br /> There will be a 2 boat limit and they are the same plans. After more discussion from all <br /> parties involved, Mr. Nelson moves to grant a Special Permit for the dock and a 6-foot <br /> variance on each side of the dock to accommodate the 15-foot setback requirements. <br /> Marshall Brem seconds the motion.
