(8) of the Zoning By-laws to build an accessory apartment above the three-car <br /> garage and attach the main residence to the accessory structure on property located in an <br /> R-3 zoning district at 701 Great Neck Road, South (Map 104 Parcel 125) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 9, 2004 and <br /> January 16, 2004 and again on February 21, 2004 and February 28, 2004, due to incorrect <br /> advertising the first time, a copy of which is attached hereto and made a part hereof. <br /> E <br /> A Public Hearing was scheduled for January 28, 2004 but due to incorrect <br /> advertising was re-scheduled and held on Wednesday, March 24, 2004 on the Petition at <br /> the Mashpee Town Hall on, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenbeny and <br /> Frederick Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Applicant was represented by attorney Mark Boudreau for this hearing. The <br /> original special permit that was granted on June 25, 2003 (SP-03-91) was appealed by <br /> Marsha and Tom Coughlin. Their attorney Mary Moehn is present at this hearing and <br /> representing their interests. The outcome of the appeal was that the first advertisement <br /> that went into the Mashpee Enterprise was not 14 days prior to the scheduled hearing but <br /> only 13 days. The Judge informed Ms. Fitzgibbon to file again with the ZBA, thus the <br /> new hearing before the Board this evening. Mr. Boudreau explains to the Board that <br />
