rowro <br /> lown of Mashpee <br /> VI e y <br /> .� MASHPEE ZONING BOARD OF A E 16 Great Vcck l�oa(l Noah,, <br /> Alastipec, Nlassachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Frank and Kimberly Silva 129 Industrial Drive <br /> Map 88 Parcel 98 <br /> SP-04-29 <br /> A Petition was filed on January 30, 2004 for a Special Permit under Sections 174- <br /> 25 (G) 4, 7 and 9 and 174-25 (H) 6 of the Zoning By-laws to build a facility to be used as <br /> a contractor's yard for landscaping, wholesale and indoor and outdoor storage on <br /> property located in an I-1 zoning district at C-2 (Map 88 Parcel 98) Mashpee, MA. <br /> i <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 6, 2004 and <br /> February 13, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 25, 2004 and continued until May 12, 2004, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, James Regan and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Laura Moynihan of Aument and Aument represents the petitioners. <br /> They are seeking a special permit(original special permit SP-01-31 has expired) to build <br /> a contractor's building for"Frank Silva Concrete Forms",petitioners business. They are <br /> seeking some outdoor storage that will be in cages no more than 20 x 20 since these <br /> things cannot be brought inside. Attorney Moynihan reviews the plans with the Board <br /> and explains that Mr. Silva would like some office space and plans to run his business <br /> between the hours of 7:00 am and 6:00 p.m. Design Review has approved these plans. <br /> The Board feels this is appropriate to the area and moves to grant the special permit. <br /> Special Permit Criteria <br /> § 9 of Chapter 40A requires: <br />
