iown of c! <br /> 16 Great,]deck load,1 [[.)rth <br /> Nlasi,tipee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> 33 Shoestring Bay Road <br /> RE: Thomas and Mariana Duncan Map 84 Parcel 24 <br /> V-04-30 <br /> A Petition was filed on January 30, 2004 for a Variance from Section 174-25 <br /> (I)(9) of the Zoning By-laws for permission to extend the maximum length of 70 feet for <br /> the construction of a pier,ramp and float on property located in an R-3 zoning district at <br /> 33 Shoestring Bay Road (Map 84 Parcel 24) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 6, 2004 and <br /> February 13, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 25, 2004 but continued and heard on April 28, 2004 due to <br /> conservation issues at which time the following members of the Zoning Board of Appeals <br /> were present and acting throughout: James Regan,Robert Nelson and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Peter Sullivan of Sullivan Engineering represents the Duncan's at this hearing. <br /> Petitioners are seeking a variance so that they may exceed the 70-foot maximum dock <br /> length in order to construct a pier,ramp and float. They have been approved by <br /> Conservation for a 6 x 25 foot float along with the other plans and Shellfish has approved <br /> them as well. After some initial confusion regarding the proper set of plans, <br /> the Board <br /> with Mr. Sullivan and discuss the length of the dock and <br /> reviews the engineering plans <br /> f whether it is from mean high water or mean low water. It is decided that the variance <br /> needed according to the plans on file would be approximately 35 feet from MHW. <br /> 0 <br />
