lown of <br /> 16 Gt ec�t Mashpee <br /> J�eek &ad,,,V <br /> nu'�C4Sl1,pCe, 1XICzssCt,clausettrs 01649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Re: Marion DeWillis 51 Orchard Road <br /> Map 62 Parcel 2 <br /> SP—04-33 <br /> A Petition was filed on February 3, 2004 for a Special Permit under Section 174- <br /> 17 of the Zoning By-laws to alter a pre-existing non-conforming structure on property <br /> located in an R-5 zoning district at 51 Orchard Road (Map 62 Parcel 2) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on February 6, 2004 and <br /> February 13, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,February 25, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Frederick Borgeson <br /> and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Ron DeWillis represents his mother at this hearing. He is seeking a special <br /> permit to alter a pre-existing non-conforming structure. There are two separate structures <br /> on the property and Mr. Wheeler has requested that he come before the Board to rectify <br /> this situation. The Board has requested an inspection from the Board of Health on the <br /> septic system and will condition this approval upon said permits. Mr.Nelson moves to <br /> grant a special permit. Motion is seconded. So approved. <br />
