This property is <br /> located in an R-5 zoning district at 51 Orchard Road (Map 62 Parcel 2) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 6, 2004 and <br /> February 13, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,February 25, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Frederick Borgeson, <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section tO and the Town of <br /> Mashpee Zoning By-laws, <br /> Mr. Ron DeWillis represents his mother at this hearing. He is seeking a variance <br /> in order to legalize this property that contains two dwellings. There are two separate <br /> structures on the property and Mr. Wheeler has requested that he come before the Board <br /> to rectify this situation. The Board has requested an inspection from the Board of Health <br /> on the septic system and will condition this approval upon said permits. Mr. Nelson <br /> moves to grant a 5,290 square foot landspace variance. Motion is seconded. So <br /> approved. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 51 Orchard Road and contains 34,710 square <br /> feet. <br />
