Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on February 6, 2004 and February 13, 2004, a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 25, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Wes Lohr, builder for the petitioner is representing Mr. Murray at this hearing. <br /> He is seeking a variance of 10-feet on the westerly side in order to rebuild a new <br /> dwelling. The Board feels this would be an improvement to the area. Mr. Nelson moves <br /> to grant a 10' variance on the westerly side. The motion is seconded and approved. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 31 Highview Avenue and contains <br /> 12,350 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br />
