Board Members James Regan (joined <br /> the meeting at 8:00 p.m.), Robert Nelson and Zella Elizenberry were present along with <br /> Associate Members Marshall Brem, Richard Guerrera and Frederick Borgeson. <br /> Clerk Robert Nelson brought the meeting to order at 7:00 p.m. <br /> Southside Realty Trust: Requests a Comprehensive Special Permit under <br /> Massachusetts General Laws Chapter 40B for 24 proposed attached and detached single <br /> family dwellings located in a C-2 and R-5 zoning district at 334 Main Street (Route 130) <br /> (Map 36 Parcel 47) Mashpee, MA. Owner: SM Realty Trust , John and Gaile McShane <br /> Trustees. <br /> The Board waited for Town Counsel Jason Talerman to arrive—during this time the <br /> Board called the following hearings: <br /> • Nancy Morey: Requests a Variance from Section 174-31 of the Zoning By-laws in order <br /> to maintain the existence of a pre-existing deck that violates the setback requirements on <br /> the side yard and rearward on property located in an R-3 zoning district at 10 Seneca <br /> Avenue (Map 65 Parcel 119J) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Richard Guerrera <br /> Attorney Craig Martin represents the petitioner. They are seeking to legalize an existing <br /> deck that was built without obtaining variance relief. Mr. Nelson informs Mr. Martin that <br /> the plot plan that was submitted is simply a mortgage inspection plan and not a certified <br /> plot plan showing the actual distance from one point to another. Mr. Martin asks for a <br /> continuance in order to obtain the proper plan for the Board. Zella Elizenberry makes a <br /> motion to continue this matter until March 24, 2004. Richard Guerrera seconds the <br /> motion. All agree. So moved. <br /> Robert L.
