Mashpee Zoning <br /> Board of Appeals Francis and Lorraine O'Brien <br /> 2 V-04-38 <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 11 Bearse Road and contains 13,000 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> l. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on March 24, 2004 <br /> to grant an 1.5-foot variance for the front yard setback requirement on Bearse Road to <br /> Petitioner. This variance is conditioned upon plans from BSS Design in Falmouth, dated <br /> February 19, 2004,job number 1021 as prepared for Frank O'Brien, and architectural <br /> drawings from E.H. Yeomans, plan no. 685-04, dated February 9, 2004. <br />
