Mashpee Zoning Terry Luff SP-04-41 3 <br /> Board of Appeals Vida#2 Trust <br /> Place for manufacturing,assembly or packaging <br /> goods,provided that all resulting cinders,dust, <br /> flashing,fumes,gases,odors,refuse matter, smoke <br /> and vapor is effectively confined to the premises or is <br /> disposed of in a manner that does not create a <br /> nuisance or hazard to safety or health. <br /> Wholesale business and storage in a roofed structure. <br /> Wholesale business and storage in a roofed structure. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 46 Nicolettas Way and consists of <br /> 60,876 square feet of land in an industrial zoning district. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules and <br /> regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> 3. there will not be an excessive demand upon community facilities created as a result of <br /> the proposal. <br /> 4. there will not be a significant adverse impact on the environmental factors listed in <br /> Section 174-24.C.2. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the Petitioner <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded,the Zoning Board of Appeals voted unanimously on February 27, 2002 to <br /> grant a Modification of a Special Permit under Section 174-25.(I-15 and G-4) on the <br /> subject property. The Modification of the Special Permit is conditioned upon compliance <br /> with the following with the plans from Cape & Islands Engineering, dated December 16, <br /> 2001, File No. 201 MA as required from the original Special Permit (SP-02-33). <br />
