Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation on March 5, 2004 and March 12, 2004, a copy of
which is attached hereto and made a part in the Town of Mashpee, on hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, March 24, 2004, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry and
Frederick Borgeson.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Michael Robbins. Builder, represents the applicants at this hearing. They are
seeking a front yard variance for the setback requirements. The lot is a corner lot and is
therefore required to maintain 2 front yard setbacks, which is burdensome to the owners
with respect to building any type of addition. They are looking for 11 feet on Oneida
Avenue and 9 feet on Annawon Road. The Board reviews the plans and discusses them
with the petitioner. Frederick Borgeson moves to grant an 11-foot variance on Oneida
Avenue and a 9-foot variance on Annaon Road. Zella Elizenberry seconds the motion.
