Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on March 5, 2004 and March
12, 2004, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on March 24, 2004 on the Petition at the Mashpee
Town Hall, at which time the following members of the Zoning Board of Appeals were
present and acting throughout: Frederick Borgeson, Robert Nelson and Zella Elizenberry.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of
Mashpee Zoning By-laws.
Mr. Trotto has arrived and the Board will hear his petition. Mr. Trotto was
granted a special permit in 1998 to demolish and rebuild a house. The permit lapsed and
he is requesting the special permit be granted to him again in order to rebuild a 3
bedroom house that he proposed to do in 1998. He reviews his newly submitted plans
with the Board and since everything has remained the same, the Board feels this is a
reasonable requests. The Board moves to grant the Special Permit.
