Desirable relief may be granted without substantial detriment to the public <br /> good and without nullifying or substantially derogating from the intent or <br /> purpose of the by-law. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on March 24, 2004 <br /> to grant a 6.8-foot variance for the side yard setback requirements on the southeasterly <br /> side. This variance is conditioned with plans from Existing Grade Incorporated of South <br /> Dennis, dated March 2, 2004, project no. 1102 and architectural plans from Tammy <br /> Depolo Drafting and Design of Mashpee, dated November 25, 2003. <br /> r <br />
