• Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 March 25, 2004 <br /> • TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, March 24, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, March 24, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members Robert Nelson and Zella <br /> Elizenberry were present along with Associate Member Frederick Borgeson. Chairman <br /> James Regan along with Associates Members Marshall Brem and Richard Borgeson were <br /> absent. <br /> Vice Chairman Robert Nelson brought the meeting to order at 7:05 p.m. <br /> Margaret Fitzgibbon: Requests a Special Permit under Section 174-25 A.8 of the <br /> Zoning By-laws in order to complete and legalize an accessory structure on property <br /> located in an R-3 zoning district at 701 Great Neck Road, South (Map 104 Parcel 125) <br /> Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Frederick Borgeson. <br /> Applicant was represented by attorney Mark Boudreau for this hearing. The original <br /> special permit that was granted on June 25, 2003 (SP-03-91) was appealed by Marsha <br /> and Tom Coughlin. Their attorney Mary Moehn is present at this hearing and <br /> representing their interests. The outcome of the appeal was that the first advertisement <br /> that went into the Mashpee Enterprise was not 14 days prior to the scheduled hearing but <br /> only 13 days. The Judge informed Ms. Fitzgibbon to file again with the ZBA, thus the <br /> new hearing before the Board this evening. Mr. Boudreau explains to the Board that <br /> nothing has changed since the last application for an accessory apartment. The <br /> greenhouse has been built to connect the 2 structures as the Board had previously <br /> requested. There are some matters of concern that the applicant still needs to work out <br /> with opposing abutters since Ms. Fitzgibbon was the general contractor for the <br /> Coughlin's house and the Blake's house. However, these matters have nothing to do with <br /> the matter before the Board at the moment. Mr. Nelson asks to hear from the opposing <br /> abutters. Attorney Mary Mohen addresses the Board. She insists her clients will suffer a <br /> loss of value in their home if this special permit is granted. They feel a rental apartment <br /> was not something they would have built a home near had they been informed of Ms. <br /> Fitzgibbon's plans to do so. The trees that applicant says they planted does not do <br /> enough to protect their privacy and they are concerned if this apartment is granted in <br /> • <br />
