Mashpee Zoning
Board of Appeals Minutes
5 March 25, 2004
board to comment so long as they have the comments for the next hearing. The Board
moves to continue the matter until April 14, 2004. All agree. So moved.
Southside Realty Trust: Requests a Comprehensive Special Permit under
Massachusetts General Laws Chapter 40B for 16 proposed attached and detached single
family dwellings located in a C-2 and R-5 zoning district at 334 Main Street (Route 130)
(Map 36 Parcel 47) Mashpee, MA. Owner: SM Realty Trust , John and Gaile McShane
Trustees
Sitting: Robert Nelson, Frederick Borgeson and Zella Elizenberry. (Marshall Brem, who
originally sat on the hearings to date was absent and Zella Elizenberry sat in for him)
Attorney Kevin Kirrane, of Dunning and Kirrane represented petitioners at this hearing.
He informs the Board of the meetings that have taken place between Horsley& Witten,
the fire department, DPW and the Mr. Rowley, Town Consulting Engineer. Sheldon
Hambline, Deputy Fire Chief, made several comments not the least of which was
requesting installation of sprinklers in each home and opening up Goodspeed Road to
better accommodate fire trucks. The applicant has informed the board and Deputy
Hamblin that it is far too costly to install sprinklers and they will not be opening up
Goodspeed Road. There are still so minor discrepancies with Greg Taylor, DPW, those
of which will be addressed more specifically when definitive plans are filed. Mr. Rowley
as stated in his letter that in summary, he would give conditional approval on the project
when definitive plans are filed as well. Justin Lamoureaux, Civil Engineer for Horsley &
Witten, discusses changes they have made regarding the entrance lanes and some
discussion on the cul de sac. They will have one lane in and one lane out (both generous
in size rather than 2 lanes). The applicant would have to take out the front cul de sac if
they were to accommodate Mr. Taylor's requests for the lane changes and they want it
there. The Board feels that a lot of work has been accomplished thus far, however, due to
a change in the current counsel representing the Board, they need to continue this hearing
one more time. They feel they should be able to close testimony by April 14, inclusive of
comments from the Board's attorney. A motion is made and seconded to continue this
hearing until April 14, 2004. All agree. So moved.
John I Trotto: Requests a Special Permit under Section 174-20 (reference expired SP-
98-138) in order to continue with the demolition and rebuild of a 3-bedroom house on
property located in an R-3 zoning district at 55 Quaker Run Road (Map 90 Parcel 40)
Mashpee, MA.
Sitting: Frederick Borgeson, Robert Nelson and Zella Elizenberry.
Mr. Trotto has arrived and the Board will hear his petition. He apologizes to the Board
and thought his hearing was at the end. Mr. Trotto was granted a special permit in 1998
to demolish and rebuild a house. The permit lapsed and he is requesting the special
