s <br /> Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 April 28, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes - Wednesday, April 28, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, April 28, <br /> 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, Robert <br /> Nelson and Zella Elizenberry were present along with Associate Members Frederick <br /> Borgeson and Richard Guerrera and Marshall Brem. <br /> Chairman James Regan brought the meeting to order at 7:00 p.m. <br /> Robert Nelson read matters that were previously scheduled for this evening but were <br /> continued for various reasons. Dry Harbor Enterprises and Nancy Morey. <br /> Kyle M. Bugg: Requests a Variance from Sections 174-31 and 174-17 of the Zoning By- <br /> laws to vary the setback requirements and to alter a non-conforming structure in order to <br /> build a 22' x 24' garage with a 30' x 6' farmer's porch on property located in an R-3 <br /> zoning district at 13 Cayuga Avenue (Map 65 Parcel 119G) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and James Regan. <br /> Kyle Bugg was present before the Board April 14, 2004 seeking a variance for setback <br /> relief in order to build a farmer's porch. The Board of Health had indicated that the space <br /> above the garage would be "uninhabitable". Mr. Bugg believed he had the authority to <br /> build a family room above the garage as long as it was not another bedroom. The Board <br /> wanted to clear up what the Health Agent referred to as "uninhabitable". Lori Corsi <br /> indicated that they meant "no bedroom allowed" but she would check into the error. At <br /> this hearing this evening, the word"uninhabitable" was incorrectly used and the Health <br /> Agent simply meant a bedroom would not be allowed above the garage. Robert Nelson <br /> moves to grant a 19.5-foot variance on Cayuga Avenue. Zella Elizenberry seconds the <br /> motion. All agree. So moved. <br /> Thomas and Mariana Duncan: Request a Variance under Section 174-25 1.9 of the <br /> Zoning By-Laws in order to build a pier, ramp and float that exceeds the 70 foot limit on- <br /> property located in an R-3 zoning district at 33 Shoestring Bay Road (Map 84 Parcel 24) <br /> Mashpee, MA. <br /> AND <br /> Thomas and Mariana Duncan: Request a Special Permit under Section 174-25 1.9 of <br /> the Zoning By-Laws in order to construct, maintain and license a pier, ramp and float on <br /> property located in an R-3 zoning district at 33 Shoestring Bay Road (Map 84 Parcel 24) <br /> Mashpee, MA. <br /> Sitting: Marshall Brem, James Regan and Robert Nelson. <br />
