Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on May 7, 2004 and May 14, <br /> 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 26, 2004, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James Regan, Robert Nelson and Zella <br /> Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Thomas Wilburn and James Cully represent the petitioners at this hearing. <br /> They are seeking a special permit in order to alter the front structure of the 99 Restaurant <br /> to handle all of the take-out the restaurant currently has. There is too much congestion in <br /> the waiting area when combined with people coming in for their take-out. They are <br /> proposing to build a small bump out away from the front of the building to accommodate <br /> just the take-out food. The Board feels this will be an improvement to the way the <br />
