Mashpee Zoning <br /> Lawrence and Josephine Cohen 2 <br /> Board of Appeals Applicant: Robert Najarian <br /> SP-04-76 <br /> lot is a combination of two lots (# 67 and 68)totaling 41,000 square feet which conforms <br /> to present-day size and frontage requirements. It also has a sub-surface sewage disposal <br /> system that has failed inspection. This structure also falls at or below the eleven-foot <br /> elevation zone. The proposed dwelling would consist of 3900 square feet of heated <br /> residential space on two floors and 1120 of unheated space, garage and game room. The <br /> lot coverage would total 12.6%. Applicant would also propose a new septic system and <br /> would meet all currently required setbacks. Mr. Kirrane informs the Board that all of the <br /> utilities will be above ground unlike the situation at hand. The Board discusses what will <br /> be in the unheated area below the flood plain. The Board feels this will be a vast <br /> improvement to the neighborhood and feels the relief sought is reasonable. The <br /> Conservation Commission has approved this dwelling as has the Board of Health with no <br /> living in the unheated area, only storage. The Board moves to grant the Special Permit <br /> for the demolition of the structure and rebuilding of the proposed house. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 8 Bowsprit Point and contains 41,618 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> Per § 174-24 of the Zoning By-laws,the Board determined that the proposed use or <br /> development: <br /> 1. is consistent with applicable state and town regulations, statutes, bylaws and <br /> plans. <br /> 2. will not adversely affect public health or safety. <br /> 3. will not cause excessive demand on community facilities. <br /> 4. will not significantly decrease surface or groundwater quality or air quality. <br /> 5. will not have a significant adverse impact on wildlife habitat, estuarine <br /> systems,traffic flow,traffic safety,waterways, fisheries,public lands or <br /> neighboring properties. <br /> 6. will not cause excessive levels of noise, vibrations, electrical disturbance, <br /> radioactivity or glare. <br />
