Mashpee Zoning <br /> Board of Appeals Minutes <br /> 6 July 14, 2004 <br /> jurisdiction of the Harbor Master and need not go to the ZBA. The Board makes a <br /> motion to formally withdraw without prejudice both matter on for Special Permit request. <br /> • Motion is seconded. All agree. So moved. <br /> Marshall Brem makes a motion to accept the minutes from June 23, 2004. Robert Nelson <br /> seconds the motion. All agree. So moved. <br /> Robert Nelson and James Regan discuss and review the Article submitted for the Town <br /> Warrant and the changes made my Tom Fudala, Town Planner. <br /> The Board discusses the letter of interest from the new applicant Clifford Peterson. It is <br /> decided that Lori Corsi will make an appointment time convenient to Mr. Regan, Mr. <br /> Nelson and Mr. Peterson to meet him. <br /> Lori Corsi informs the Board that the major modification filed by McShane Construction <br /> was sent to Jay Talerman for review. Attorney Talerman feels applicant needs to go back <br /> to Mass Housing for proper permitting. <br /> The 99 Restaurant has brought in a different set of plans for construction. They have <br /> reduced the size of the addition from 20' to 8'. They have been approved for the <br /> previously larger addition, but would like to know if they need to come back and refile <br /> with the newly reduced plans. The Board reviews both the old plan and the newly <br /> proposed plan and see no need to come back since it is actually smaller. Marshall Brem <br /> makes a motion to accept the new plans from the 99 Restaurant and the smaller addition. <br /> Mr. Nelson seconds the motion. All members vote favorably. It is noted that a memo <br /> with signatures would be sufficient. The new plans now will reference Job No. A-04057, <br /> dated May 6, 2004 and revised on July 6, 2004 to reflect the 8' foot to go addition. Lori <br /> Corsi to notify John Hutchins of the approval. <br /> James Regan discusses Lori Corsi's review that he would like comments from the Board <br /> on. Lori Corsi leaves the meeting while the Board discusses her review. At this time, <br /> Marshall Brem makes a motion to adjourn the meeting. Richard Guerrera seconds the <br /> motion.
