(01Pry <br /> lown of Mashpee <br /> 16 Gi ?at_Neck &,)ad..Nol t12, <br /> Njashpc1e, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Willowbend Country Club, Inc. 37 Shoestring Bay Road <br /> Map 84 Parcel 25 <br /> SP-04-118 <br /> A Petition was filed on July 30, 2004 for a Special Permit under Section 174- <br /> 25.I.9 of the Zoning By-laws to construct, license and maintain a pier, ramp and float in <br /> Shoestring Bay on property located in an R-3 zoning district at 37 Shoestring Bay Road <br /> (Map 84 Parcel 25) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 6, 2004 and <br /> August 13, 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Zella E. Elizenberry, Robert <br /> Nelson, Marshall A. Brem, James Regan and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Jack McLinney represented petitioner at this continued hearing. They <br /> were originally before the Board on November 10, 2004 for a Special Permit when they <br /> realized the dock was longer than the 70 foot maximum that is allowed without a <br /> variance. Petitioner decided to reduce the length of the dock to 70 feet and continue the <br /> matter until December 8, 2004. The Board again reviewed the plans and noted that the <br /> dock was reduced to 70 feet in length from the MHW. The Board moves to grant the <br /> Special Permit. <br />
