Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 6, 2004 and August <br /> 13, 2004, a copy of which is attached hereto and made a.part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Tuesday, <br /> August 24, 2004, at which time the following members of the Zoning Board of Appeals <br /> were present and acting throughout: Marshall Brem, Robert Nelson, James Regan. and <br /> Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering along with Anthony Ferragamo, <br /> Ferragamo Engineering, represents the petitioners at this hearing. They are seeking a <br /> special permit to demolish the existing structure and build a new house along with a <br /> variance for relief from the setback requirements in order to complete the proposed <br /> dwelling, that Mr. Ferragamo is handling. The house was built in 1967 and was built 2 <br /> feet over the property tine on abutter's property. This matter must be rectified. Mr. <br /> Ferragamo proposes to slide the new dwelling over while maintaining the 15-foot side <br /> yard setback requirements. 7.1 hey will not however, be able to maintain the 40-foot front <br /> yard setback requirement and need a variance for this aspect of the project.
