Mashpee Zoning <br /> Board of Appeals Minutes <br /> 6 August 24, 2004 <br /> Counsel before they proceed since they have not done anything like this before and they <br /> want to be sure they follow the correct procedure. The Board completely concurs with <br /> the abutters about revoking the special permit. However, until we can get some <br /> comments from Town Counsel on the procedure to do this, they feel it would be in the <br /> best interest of the community to continue this matter until September 8`h. If they take it <br /> under advisement, they would no longer be able to listen to any more testimony. So the <br /> motion is made to continue the matter until September 8, 2004. All agree. So moved. <br /> Other Business: <br /> The Board discusses their opinion of the DCPC question. Joyce Mason has asked for <br /> comments from all of the regulatory boards. <br /> Mr. Regan feels that invoking this DCPC would trigger widespread 40B filings, <br /> which would clearly be detrimental to the community and its resources. He feels some <br /> immediate quick fixes would be better signage going into Jobs Fishing Road so people <br /> would use that roadway more and reduce rotary traffic. <br /> Mr. Nelson feels a town wide DCPC would not work but perhaps a one-mile <br /> stretch from the rotary and strip of Rte 151, 130 and 28 would be better. <br /> Mr. Brem feels this is not for the ZBA to decide. <br /> Mr. Guerrera has spoken to people in Nantucket where a DCPC has been <br /> implemented, cancelled then implemented again and its has not worked very well at all. <br /> It has hurt the economy and the construction. He is not in favor of it at this time. <br /> Mr. Nelson mentions one of the continued matters for Bourne Petroleum. In an R-3 <br /> zoning district the sign size that is allowable is 4' x 6'. He has spoken with Mr. Fudala <br /> regarding this and he feels they would go a little bigger. Mr. Bourne did not show up for <br /> his hearing with Design Review so they could inform him of this. <br /> Mr. Nelson makes a motion to accept the minutes of July 28, 2004 with his suggested <br /> corrections. Mr. Regan seconds the motion. All agree. So moved. <br /> Mr. Regan re-introduces Clifford Peterson, an interested applicant as an alternate <br /> for the ZBA and the Board continues with the interview. <br /> Mr. Brem makes a motion to adjourn at 10:20 pm.
