Mashpee Zoning <br /> Board of Appeals Minutes <br /> 3 September 8, 2004 <br /> Zella Elizenberry: Although she was not part of the previous hearing, upon passing the <br /> • store on Route 130, she felt it has become an eyesore to say the least. <br /> Robert Nelson: He discusses the hours of operation. Is it 7:30 a.m. to 4:00 pm? At <br /> least that would not be as early as 6:30 or so. He feels an 8 foot fence with slats to block <br /> the view and the noise would be appropriate. He also informs them that the issues of 544 <br /> Main Street must be kept separate from any other matter. We can only deal with the <br /> property under the special permit right now. <br /> Mr. Nelson also indicates that there may be a quorum problem if everyone does not vote <br /> in a favorable manner. There were only 4 members sitting at the time and all must vote <br /> favorably in order to revoke the permit. <br /> In summary, the Board discusses three things they would like to see: <br /> 1. fence slats <br /> 2. more bushes <br /> 3. a site visit. <br /> It is dicussed with all parties involved that a site visit will take place at 11:00 a.m. on <br /> Wednesday, September 22, 2004 to see what has been accomplished. It will be posted on <br /> the agenda as such. <br /> Mr. Wickstom addresses the board one last time. He would like them to know that he <br /> wants to make his business attractive and clear up this problem for the residents. He <br /> want to be cooperative in every way he can. The Board just feels it is unfortunate that it <br /> took seven years to get to this point with the residents so upset. The Board also discusses <br /> amending the decision to reflect some specific problems. Attorney Boudreau mentions a <br /> dig safe problem. Mr. Shelton informs the board that dig safe comes out pretty quickly <br /> and not to postpone this matter any more than they have to. Marshall Brem makes a <br /> motion to take this matter under advisement—therefore meaning no more testimony may <br /> take place from either side. Robert Nelson seconds the motion. All agree. So moved. <br /> This matter will be continued until September 22, 2004 at which time a site visit will <br /> have taken place at 11:00 a.m. the morning of the hearing. <br /> At this point, Mr. Regan moves the agenda around since he is not able to sit on several of <br /> the hearings to a conflict of interest. <br /> Bourne Petroleum: Requests a Special Permit from Section 174-51 D to install a 8' x 4' <br /> sign on property located in a C-1 zoning district at 135 Main Street (Map 37 Parcel 58) <br /> Mashpee, MA. <br /> Sitting: Robert Nelson, Marshall Brem, Richard Guerrera, Zella Elizenberry and James <br /> Regan.
